RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2009-01169 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: Her date of separation (DOS) be changed from 30 July 2008 to 2 January 2009 in order to keep her active duty promotion to the grade of major with a date of rank (DOR) and effective date of 1 January 2009. ______________________________________________________________ APPLICANT CONTENDS THAT: She spoke with the Air Reserve Personnel Center (ARPC) to discuss her transition from the Regular Air Force (RegAF) to the Reserves and her existing active duty promotion to major. She submitted a request for an accelerated promotion in accordance with (IAW) AFI 36-2504, Officer Promotion, Continuation and Selective Early Removal in the Reserve of the Air Force and requested a 31 July 2008 promotion to the grade of major pin on date. ARPC informed her the Academy position was not considered a “position” IAW AFI 36-2504 because it was unfunded. A 30 July 2008 DOS was requested based on counseling from ARPC that her promotion to the grade of major would carry over to the Reserves. She wanted to live closer to her family during the last eight months of her husband’s deployment to Afghanistan. Otherwise she would have stayed to keep her pending promotion to the grade of major. ARPC stated there was no exception to policy and 2 June 2010 was the earliest she could be promoted to the grade of major. She was unaware the new position would prevent her from receiving an accelerated promotion to the grade of major. In support of her request, applicant provides a copy of a memorandum recommending her for promotion to the Reserve grade of major. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: On 2 June 1999, applicant entered the RegAF and was progressively promoted to the grade of captain, having assumed that grade effective and with a DOR of 2 June 2003. The applicant met and was selected for promotion to the grade of major by the CY07A Major Central Selection board that convened at the Air Force Personnel Center (AFPC) on 10 September 2007. Effective 30 July 2008, she was separated (Resignation) from active duty after serving 9 years, 1 month and 29 days on active duty. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSOO makes no recommendation and states that had the applicant remained on active duty she would have been promoted to the grade of major with a DOR and effective date of 1 January 2009. The complete DPSOO evaluation is at Exhibit B. AFPC/DPSOS recommends denial of the applicant’s request to change her DOS and does not believe she should be credited with active service she did not perform. The complete DPSOS evaluation, with attachment, is at Exhibit C. ARPC/DPB recommends denial and states the applicant's active- duty promotion transferred to the Reserves with a DOR and effective date to the grade of major established as 2 June 2010. This action was based on current Reserve requirements for in-the-promotion zone (IPZ) promotions. On 18 April 2008, a request for an accelerated promotion with a DOR and effective date of 31 July 2008 was requested. The criteria for an accelerated promotion established in AFI 36-2504 states that an officer must be assigned to the Selected Reserve Program. She is not assigned to the Selected Reserve but in the Individual Ready Reserve (IRR) as an Air Force Academy Liaison officer. As such, she is not eligible for accelerated promotion in this category. The complete DPB evaluation is at Exhibit D. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 31 July 2009 for review and comment within 30 days. As of this date, this office has received no response (Exhibit E). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After a thorough review of the evidence of record and careful consideration of the applicant's contentions, we find no evidence that her DOS or DOR to the grade of major are erroneous and are not persuaded by her assertions that she has been the victim of an error or injustice. Therefore, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as basis for our conclusion that the applicant has not been the victim of an error or injustice.
